HCSD Rules and Regulations Governing Access to Records

 Freedom of Information Act

Requests for inspection and/or copies of records should be made to the Records Access Officer, Christine Ljungberg.  These requests may also be made by email.  To make this request via e-mail, please send an email to cljungberg@hcsdk12.org with the subject line, “FOIL Request.”

Requests to inspect or secure copies of records may be made to the Records Access Officer on any business day between the hours of 8 AM and 4 PM, either via email or in person at 5305 Abbott Road, Hamburg, NY.  A list of available records can be found here.

The following procedures shall be followed in connection with requests to inspect or secure copies of records:

  1. Requests to inspect or secure copies of records shall be submitted to the Records Access Officer on a form, designated by the Superintendent, copies of which are available in the office of the Records Access Officer, and on the District’s website.
  2. The Records Access Officer will grant or deny access or minimally acknowledge receipt of the request within five (5) business days of the receipt of the request.
  3. Generally, the Records Access Officer will provide to the requestor the requested records within twenty (20) business days of the receipt of the request.
  4. For requests approved in whole or in part, but where circumstances prevent disclosure of information within twenty (20) business days from the date of the acknowledgment of the receipt of the request, an explanation will be provided in writing concerning the delay, including a date by which the request will be granted in whole or in part.
  5. For records which are determined not to be available, the Records Access Officer will notify the requestor, in writing, and return the request form to the requestor.
  6. For requests to inspect records, the inspection must take place at the Hamburg Administration Building, located at 5305 Abbott Road, Hamburg, NY 14075 and records may not leave the premises.
  7. Requests for copies of available records will be honored, upon payment of the required fee, provided the requestor and the record of which a copy is requested are sufficiently identified to make compliance practicable.

Appeals of any records request denied must be in writing to the Superintendent of Schools within thirty (30) calendar days of the date or denial of access.  Decisions on appeals will be rendered in writing by the Superintendent of Schools within ten (10) business days of receipt of appeal.
